In Malta, fathers and equivalent second parents have a right to 10 working days of paid paternity leave on the occasion of the birth or adoption of a child. DIER says the leave is taken immediately after birth or adoption and is not subject to a length-of-service qualification. Employers in the applicable scheme pay the employee and can then seek a refund from the Department of Social Security Trust Fund.
This page is written for Malta and uses English, one of Malta’s official languages. It separates the employee’s request from the employer’s refund process so the letter can remain simple while the payroll section contains the key Trust Fund points.

How should an employee request paternity leave?
Keep the employee request short: identify the birth or adoption, confirm the date, state the 10 working day leave period and ask the employer to record it. Follow any internal HR notice procedure as well.
Employer Trust Fund refund
The Social Security Department states that the employer pays the employee for the 10 working days and may then submit an online refund claim for the applicable amounts. The claim can cover gross basic wage, pro-rata statutory bonuses and allowances, and the employer portion of social security contributions, subject to the scheme rules.
Documents and records
For the refund claim, Social Security lists documents such as payslips for the paternity leave period, and an adoption certificate where the leave concerns adoption. The employee should still follow the employer’s normal HR documentation requirements.

The template below is suitable for an employee request. An employer making a Trust Fund claim should use the Department of Social Security’s online process rather than treating the employee letter as the refund application.

I would like to take the statutory 10 working days of paternity leave from [start date] to [end date], in accordance with the applicable Maltese employment rules.
